I may have mentioned we have a somewhat handicapped son. he is difficult to live with, especially since he really does not want to live with us, since he is "grown up" well. On our road, a little bitty house, about 600square feet went on sale. we were interested for our son and he really had his heart set on it. it would have been very convenient for us all. within walking distance to us, and every time I go someplace i would have to go right by it. we contacted the sellers, ( a bunch of folks who inherited theplace from their uncle), we contacted the people, made an offer, we agreed on a price, and then we waited and waited. Now we find out it is sold. Of course they can do with their property what they want to, but wouldn't it have been the proper thing to do if they had a better offer by someone else to ask if we wanted to meet that price? we would have and our son has been devastated and crying.

Some people will do anything for a buck even if it means forgetting about manners or being honest. You all have the right to be upset as the seller should have contacted you all.

Can the seller do that? Yep. Is is the honest and decent thing to do? Nope. That is people and human nature for you.

For future reference, when you make a real estate agreement; have the seller sign a real estate contract AND you give them earnest money in the form of a check which can either go towards the purchase price or be returned to you at closing. I typically have both the seller and myself sign the contract in the closing attorny's office AND have the closing attorney hold the check until closing.

Once you have a signed contract and have given "consideration" (ie: the earnest money check) you now have a legally binding contract. If the seller sells the property out from under you after they have signed the contract AND take earnest money...........well let's just say that gives you a much wider range of options to pursue for damages and even to stop the sale.

Sorry things didn't work out.
