{"id":2711,"date":"2014-05-09T09:46:57","date_gmt":"2014-05-09T13:46:57","guid":{"rendered":"http:\/\/backwoodshome.com\/blogs\/MassadAyoob\/?p=2711"},"modified":"2014-05-09T09:46:57","modified_gmt":"2014-05-09T13:46:57","slug":"who-do-you-want-on-your-jury","status":"publish","type":"post","link":"https:\/\/www.backwoodshome.com\/blogs\/MassadAyoob\/who-do-you-want-on-your-jury\/","title":{"rendered":"WHO DO YOU WANT ON YOUR JURY?"},"content":{"rendered":"<p>So here I am, sitting in the back of the classroom with a laptop.\u00a0 My co-instructor Attorney Jim Fleming and I are teaching a CLE (<a href=\"http:\/\/www.selfdefenselegaltraining.com\/\" target=\"_blank\">continuing legal education<\/a>) course geared for attorneys, on the topic of self-defense cases.\u00a0 Jim is talking about jury selection.<\/p>\n<p>Some of his advice is counterintuitive, but hell, if trial law was all intuitive, no one would need continuing training, would they?\u00a0 And some in the audience are shocked when he says that as a criminal defense lawyer, he LOVES to have cops on his clients\u2019 juries.\u00a0 Of course, this is 180 degrees counter to conventional wisdom.\u00a0 If the game is cops and robbers and your client has been cast in the role of the accused robber, wouldn\u2019t a member \u201cof the other team\u201d be the LAST person you wanted on your jury?<\/p>\n<p>Jim explains that police officers mediate disputes almost daily, from two angry drivers at an accident scene to spouses in mortal rage when the officers arrive to break up a \u201cdomestic.\u201d\u00a0 They\u2019re attuned to listening to both sides.\u00a0 During <i>voir dire, <\/i>the jury selection process, he\u2019ll make a point of asking any cops in the jury pool if they can be fair to someone other cops have arrested.\u00a0 He has found over the decades that these cops can be the most scrupulous of jurors\u2026and other jurors, having heard this discussion with them, are reminded of their own duty to be fair and impartial.<\/p>\n<p>Many of you reading this have served jury duty yourselves.\u00a0 What are <i>your <\/i>thoughts and observations on this topic?\u00a0 If you were, let\u2019s say, charged or sued after a self-defense shooting, who would you want on \u2013 and off! \u2013 the jury that judged <i>you?<\/i><\/p>\n","protected":false},"excerpt":{"rendered":"<p>So here I am, sitting in the back of the classroom with a laptop.\u00a0 My co-instructor Attorney Jim Fleming and I are teaching a CLE (continuing legal education) course geared for attorneys, on the topic of self-defense cases.\u00a0 Jim is talking about jury selection.
