{"id":4237,"date":"2017-06-27T08:23:47","date_gmt":"2017-06-27T12:23:47","guid":{"rendered":"http:\/\/backwoodshome.com\/blogs\/MassadAyoob\/?p=4237"},"modified":"2017-06-27T08:23:47","modified_gmt":"2017-06-27T12:23:47","slug":"scotus-denies-cert-in-peruta","status":"publish","type":"post","link":"https:\/\/www.backwoodshome.com\/blogs\/MassadAyoob\/scotus-denies-cert-in-peruta\/","title":{"rendered":"SCOTUS DENIES CERT IN PERUTA"},"content":{"rendered":"<p style=\"text-align: left;\">Well, damn.<\/p>\n<p style=\"text-align: left;\">We\u2019d all had hopes that the current Supreme Court of the United States would review and overturn the <em>Peruta <\/em>decision, in which the Ninth Circuit had upheld the right of California authorities to issue concealed carry permits at will, rather than the growing modern norm of \u201cshall issue.\u201d\u00a0 I for one was surprised when SCOTUS denied cert.\u00a0 The brilliant dissent of Justice Clarence Thomas is here: <a href=\"https:\/\/www.supremecourt.gov\/opinions\/16pdf\/16-894_p86b.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/www.supremecourt.gov\/opinions\/16pdf\/16-894_p86b.pdf<\/a>.\u00a0 A tip of the hat to TN_Man, a regular commenter on this blog, who was the first to post it here.<\/p>\n<p style=\"text-align: left;\">Dave Workman is an old friend and a keen observer and analyst of 2A issues.\u00a0 His take on the matter is here: <a href=\"http:\/\/libertyparkpress.com\/disfavored-right-scotus-denies-california-carry-case\/\" target=\"_blank\" rel=\"noopener\">http:\/\/libertyparkpress.com\/disfavored-right-scotus-denies-california-carry-case\/<\/a>.<\/p>\n<p style=\"text-align: left;\">Another long-time fighter for gun owners\u2019 civil rights, David Hardy, weighs in here: <a href=\"http:\/\/armsandthelaw.com\/archives\/2017\/06\/thoughts_on_the_16.php\">http:\/\/armsandthelaw.com\/archives\/2017\/06\/thoughts_on_the_16.php<\/a>.<\/p>\n<p style=\"text-align: left;\">There is no more outspoken advocate for 2A rights than David Codrea, who comments here: <a href=\"https:\/\/www.ammoland.com\/2017\/06\/scotus-keeps-door-open-on-travel-ban-slams-it-in-faces-of-gun-carriers\/#axzz4lCAyagBU\">https:\/\/www.ammoland.com\/2017\/06\/scotus-keeps-door-open-on-travel-ban-slams-it-in-faces-of-gun-carriers\/#axzz4lCAyagBU<\/a>.<\/p>\n<p style=\"text-align: left;\">My own take?\u00a0 In too many jurisdictions, \u201cmay issue\u201d \u2013 still the California standard \u2013 has become a synonym for \u201cWe\u2019ll grant you the permit if you\u2019re white, male, rich and politically connected.\u201d\u00a0 In Northern California, several elected sheriffs have gone with a <em>de facto <\/em>Shall Issue policy, and as has happened everywhere else, predictions of blood running in the streets have been proven wrong.<\/p>\n<p style=\"text-align: left;\">Under \u201cmay issue,\u201d there are generally two standards commonly cited for granting the permit.\u00a0 One is \u201cthe applicant carries large amounts of money or other valuables and is at higher risk for armed robbery.\u201d\u00a0 That\u2019s certainly a good reason, but a tenet of American law is that life is of much greater value than \u201cmere property\u201d including cash. \u00a0The reason we are allowed to use deadly force against armed robbers is the accompanying threat to the victim\u2019s life, not the cash in their pocket or bank deposit bag.\u00a0 We live in a world where people are robbed and murdered for their running shoes, for God\u2019s sake.<\/p>\n<p style=\"text-align: left;\">The other most commonly cited reason for granting the permit in May Issue states is credible death threats to the applicant.\u00a0 Waiting for the death threat misses entirely the point of carrying a defensive firearm.\u00a0 You don\u2019t wait to buy a fire extinguisher for your car until the first wisps of smoke drift up from under the dashboard; it\u2019s too late.\u00a0 In the same vein, waiting to apply for a permit to carry a gun to protect yourself and your loved one is likely to leave you unarmed and helpless when the danger first strikes.<\/p>\n<p style=\"text-align: left;\">Shall Issue, now the prevailing norm, should be the <em>universal<\/em> norm, and there are good reasons why more than a dozen states now have gone a step farther and dispensed with the permit, allowing permitless carry (a\/k\/a Constitutional Carry) for all law-abiding citizens.<\/p>\n<p style=\"text-align: left;\">It is sad that SCOTUS turned down this opportunity to rectify this very real public safety concern.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Well, damn.
