I am very concerned about knee-jerk \u201cred flag laws,\u201d a\/k\/a ERPOs, or Extreme Risk Protection Orders.\u00a0 All the suggested ones I\u2019ve seen so far are so poorly written they\u2019re dangerous.\u00a0 I explained why here<\/a> last month.\u00a0 A couple of entries ago,<\/a> I shared a link in which pro-Second Amendment attorneys gave pretty much unanimous advice that if police came to serve such an order on one of us, the best advice was to not resist and seek legal redress.<\/p>\n\n\n\n

If you read\nthe comments in the latter, you\u2019ll see that it resulted in a crap storm.  Now, as the guy who\u2019s been writing this blog\nfor a decade, it may be time for me to explain some things.<\/p>\n\n\n\n

Opposing\nviews are encouraged here. They nourish meaningful dialogue.  The folks who called me a boob and all that\nare still welcome to comment here.  As\nthe moderator, I only have to remove about one reader comment every two or\nthree months, and that\u2019s usually for viciously attacking another\ncommenter.  (I post this stuff, so I\u2019m\nfair game. Guests in my house are welcome to disagree, but not to make nasty\npersonal attacks on each other.)  On rare\noccasions I have to delete for F-bombs, and a VERY few times I\u2019ve had to\nbecause the guy who wrote the comment was simply bat-feces crazy.  And I can still count on my fingers the\nnumber of people I\u2019ve banned here in over a decade and have some digits left\nover.<\/p>\n\n\n\n

I\u2019ve already\nhad to delete multiple comments and ban multiple posters in the \u201cIf the Police\nCome for Your Guns\u201d comment thread.<\/p>\n\n\n\n

So\u2026<\/p>\n\n\n\n

First, if\nyou write the suggestion that people should murder the families of police to\nintimidate them, you are not wanted here. The kind of person who says that is\nthe kind of person who needs <\/em>to have\ntheir weapons confiscated.<\/p>\n\n\n\n

Second, if\nyou pound your chest and claim you\u2019ll shoot people you KNOW are police serving\na warrant that you don\u2019t like because your interpretation of the law is\ndifferent from the judge\u2019s, you\u2019re a damn fool and anyone stupid enough to follow\nyour advice would get killed like you will in a gunfight you could have\navoided, a gunfight in which your loved ones are in the line of fire.  That\u2019s why all those lawyers in that link\nsaid to work it out in court.<\/p>\n\n\n\n

Third \u2013 and\nthis is mainly for the first-time, drive-by commenters who heard about my blog\non someone else\u2019s, got pissed, and obviously never read<\/em> what I wrote, nor the link therein \u2013 understand that when you\nliterally don\u2019t know what you\u2019re talking about, what you say is meaningless.<\/p>\n\n\n\n

Fourth,\nthink context. <\/em>We\u2019re not talking\nabout Red Dawn here, or a reincarnation of some real-life Johnny Tremaine\nfighting the redcoats. We have been talking about potential abuse of poorly\nwritten red flag laws, to wit, some snowflake, stalker, or harasser making a\nfalse complaint that results in a warrant. \nYou will probably have a damn good idea who that is, and if you follow\nthe advice of the lawyers in the earlier link, either the police or your\nattorney\u2019s investigator will find out the truth and things will be squared\naway. If you tell people to start shooting under those circumstances, you\u2019re\neither an anti-gunner trying to damage gun owners\u2019 civil rights or have become\nan unwitting puppet of same.  What will\nwin this will be common sense presented to the lawmakers and the public to\nprevent onerous laws from being enacted in the first place.<\/p>\n\n\n\n

Second\nAmendment and <\/em>First are still\ncelebrated here.  But so is critical\nthinking, common sense, and knowing what the hell one is talking about.<\/p>\n","protected":false},"excerpt":{"rendered":"
